
Earning Capacity Evaluations
Lost
earning capacity evaluation is conducted by a vocational
expert, and on occasion a vocational rehabilitation
counselor. Economic loss issues are evaluated as a
result of injury, accident or other disabling condition.
Marriage dissolution can require an assessment of the
spouse's present earning capacity and financial status.
A vocational expert will review the individual's present
job earnings and benefits, and make a determination on
lost earning capability when a career is truncated. In
legal cases, vocational expertise can be coordinated
with an economist.
Types of evaluations:
- Loss of earning
capacity in worker compensation analyzes the time
loss between determination of able to work and claim
closure.
- Economic loss in
medical malpractice analyzes the job loss or the
truncated career advancement loss. It includes
socio-economic impact, adaptive/ergonomic equipment
needs, or other specific needs relating to the
individual.
- Personal injury
cases require a determination of the present
earning/benefit capacity of the individual in
relation to the loss of the job during medical
recovery, and/or permanent loss of the job.
Determination can be made regarding potential job
option(s) utilizing transferable skills or alternate
job options with earning capacity. If/when
retraining is considered, new career earning
potential is established.
- In marriage
dissolution the present earning capacity is
analyzed. In the case of absence from the work
force, multiple factors are analyzed to arrive at
probable earning capacity with or without new skills
or training. A Vocational Evaluation, Disability
Evaluation, Vocational Rehabilitation Counseling or
Career Counseling will determine the maintenance
time needed, services required, the cost and time
necessary to establish employment appropriate to the
spouse's skills, interests, style of life, and other
attendant circumstances.
- In the event of
relocation, geographic wage and benefit analysis is
performed specific to the new residence.
